AN ACT CONCERNING THE PLACEMENT OF IDENTIFYING MARKS

ON DENTAL PROSTHESES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

1 Section 1. (NEW) (Effective October 1, 2008) Each dentist licensed in
2 this state who either makes or directs to be made a removable
3 prosthetic denture, bridge, appliance or other structure to be worn in a
4 person's mouth, shall offer to the patient for whom the prosthesis is to
5 be made, the opportunity to have such prosthesis marked with the
6 patient's name or initials. Such markings shall be accomplished at the
7 time the prosthesis is made and the location and methods used to
8 apply or implant such markings shall be determined by the dentist or
9 person directed to act on behalf of the dentist. Such marking shall be
10 permanent, legible and cosmetically acceptable. A dentist shall advise
11 the patient of any additional charges that may be incurred to obtain
12 such markings on the prosthesis. Notwithstanding the provisions of
13 this section, if in the professional judgment of the dentist or the entity
14 that is making the prosthesis, such markings are not practicable or
15 clinically safe, the identifying marks may be omitted entirely.

This act shall take effect as follows and shall amend the following
sections:
Section 1 October 1, 2008 New section
Statement of Purpose:

To enact legislation that will require licensed dentists to offer to those patients who require removable prosthodontic appliances the opportunity to have identifying marks placed on such dental prostheses.
